Patient Rights and Responsibilities (Related to Article 1-3, Paragraph 1)
1. Patient Rights
A. The right to receive medical treatment
Patients have the right to receive appropriate healthcare services for the protection and promotion of their health. They shall not have their health-related rights infringed upon on the grounds of gender, age, religion, status, or economic circumstances. Medical professionals may not refuse treatment without just cause.
B. Right to Know and Right to Self-Determination
Patients have the right to receive a thorough explanation from their attending physician, nurse, or other healthcare provider regarding their medical condition, treatment methods, eligibility for medical research, organ transplantation, expected outcomes including side effects, and treatment costs. They may ask detailed questions and have the right to decide whether to give consent regarding these matters.
C. The right to protection of confidentiality
Patients shall not have their physical and health-related secrets or privacy infringed upon in connection with medical treatment. Medical professionals and institutions may not disclose or publish such secrets except with the patient's consent or in cases prescribed by law, such as criminal investigations.
D. The right to request counseling and mediation
Patients may seek consultation and apply for mediation at organizations such as the Korea Medical Dispute Mediation and Arbitration Center in the event of a dispute related to medical services.
2. Patient's Obligations
A. Duty to Trust and Respect Healthcare Providers
Patients should accurately disclose their health-related information to healthcare providers and trust and respect the healthcare provider's treatment plan.
B. Obligation not to receive medical treatment through fraudulent means
Patients must identify themselves before receiving medical treatment and shall not receive treatment under another person's name or through false or fraudulent means.
